The Act is not designed to be used to bring actions against private individuals. For people with learning disabilities, the Act should reinforce a 'rights culture', ensuring that people working to support people with learning disabilities recognise the need to ensure that everyone receives the benefit of the law. Working with the Human Rights Act The Human Rights Act is designed to affect the way Public Authorities behave, and to ensure they pay attention to people's rights. Whilst it does not introduce new rights, it should make the process of claiming rights easier, as this can now be heard by a court or tribunal in the UK. The Act is described as a 'higher law' which sets out basic values aimed at changing the way authorities and individuals think and act, including the development of policies. The rights in the Act are not limitless, and they are written in a way to ensure that the claiming of human rights by one individual does not ride roughshod over the rights of another, or those of the local community or society more broadly. Issues of balancing rights and responsibilities remain, and Public Authorities providing services need to ensure that they address this balance continuously. The Act is not designed to be used against private individuals: it is not possible to sue or be sued by another for breaking the rights in the convention. However, it may be easier to explain how your rights are being affected by individuals by referring to the Act and the written articles. It is hoped that the Act will not increase the number of court cases in the UK, as going to court should be seen as a last resort. People with Learning Disabilities and the Human Rights Act For people with learning disabilities, it is hoped that the Act reinforces a new 'rights culture', which means that everybody working to support people with learning disabilities recognise the need to ensure that everyone receives the benefit of the law regardless of race, ethnicity, religion, sex, mental, physical or learning disability. Most incidents of abuse of rights that occur should be resolved locally without recourse to courts, but this will require training and support for staff. Clearly the right to freedom of expression within the Act applies to staff concerned about treatment of individuals, and who want to 'whistle-blow'. If you have a concern about the violation of human rights of somebody with a learning disability, you can: Take the person's concerns seriously Seek advice from a social services care manager or a member of the local community learning disability team Seek advice or help from a local self advocacy or citizen advocacy group Contact the Social Services Inspection Team or the Community Health Council.
